The H-2B Visa for Seasonal Workers

Some of the seasonal industries find difficulty to locate seasonal employees. This is due to the reason that they will have a very short time of the jobs and the work that is involved in a given task. At this point of time, the H-2B visa comes in to picture. Some of the common industries, which use the H-2B visas, are resorts, theme parks, nurseries, carnivals, fairs, lawn, hospitality industry, golf courses and snow removal. This H-2B visa is not limited to a particular industry. But, the h2b visa cannot be used for agricultural purposes.

The h2 visa are not limited to any particular country. From many countries like Mexico, China, Russia, South Africa, etc… the workers with that particular skills come and work for some particular period. To simplify the process, the workers were hired from one particular country. As the workers come from the same location, the visa will be applied at the same time for all the members.

Non-permanent labor:

The first eligibility is that the work should be seasonal. After the completion of work, the employees should go back to their home country and should not use the visa for an ongoing work. Every job will meet this criterion as they are seasonal employment.

Department of Labor:

To hire the employers from other country, the employee should first take the labor certification from the United States Department of Labor. The employee should prove that the work is seasonal and the citizens of the United States are un-willing to do that particular work.

The process and the procedure of the h2b visa changes every year. So, it is advisable for you to take the assistance from a lawyer for the group petition.
